Josh Duggar ’19 kids’ star appeals real estate lawsuit after being a no show twice

ARKANSAS (KNWA / KFTA) – The real estate lawsuit against ALB Investments, LLC, affiliated with Josh Duggar, is still ongoing. Duggar’s new attorney seeks the annulment of the September 2020 “Quiet Title” court ruling.

In January 2021, Springdale attorney Samuel Adam Martin filed a motion against Carl Echols (Appellate Leader) in the Arkansas Court of Appeals on behalf of ALB Investments, LLC.

The complainant applies for a “request for relief (applies to a higher court to set aside the decision of a lower court – basically an amendment to the action).

In the 21-page letter filed in March 2021, Martin argued that the court made a mistake by removing the first lawyer, Travis Story, among other things.

Story was disqualified by the judge for being listed as ALB’s tax records manager, creating a conflict of interest.

The lawyer who replaced Story was Joshua Bryant. Bryant is currently listed as a registered agent for ALB Investments, LLC and Story as an officer. This was found in a website search by the Arkansas Secretary of State on May 17, 2021.

The real estate lawsuit involves Carl Echols, Edward L. Lewis and ALB Investments, LLC. In April 2019, Echols sued his cousin Lewis, accusing him of reselling properties he bought from him for $ 17,500 in 2006.

Echols and his family had lived and paid taxes on the property. In 2016, Lewis sold the property for $ 1,000 to ALB Investments, a company that Duggar had listed as a registered agent. Echols went to court and said the property had been sold without his knowledge.

On September 30, 2020, a Benton County judge ruled in favor of Echols and a “silent title” was ordered.

Now to the recent lawsuit [filed in March 2021]The case is being handled by a third lawyer, Martin, who has filed an appeal.

“We won the actual case. My client, Carl Echols, has received a certificate and the property bears my client’s name, ”said attorney Kesha (Chiappinelli) Zaffino.

Zaffino will not represent Echols in the appeal process, for one reason she does not do any appeal work.

When Duggar did not show up for the final hearing after Story was released from the case, Zaffino politely called Josh and asked if he knew he was in court [that particular day].

“He told me he didn’t know he had court and then talked about other things … he didn’t seem to care,” said Zaffino. “I might be thinking of Travis [Story] I forgot to tell him since he’s no longer Duggar’s lawyer. That’s why I gave it [Duggar] a courtesy call, and I could legally because, as far as I knew, he was not represented by a lawyer at the time. “

Echols’ attorney had offered to settle the lawsuit before the trial scheduled for April 27, 2020.

If Martin’s appeal is won, it means the case would start over in a lower court. Echols is under no obligation to respond to the appeal as it will not lose anything. ALB Investments, LLC was incorporated in Arkansas on August 24, 2015.

The currently registered agent is Joshua Bryant, 9 Halsted Circle, Rogers, Arkansas. Travis W. Story is the founder / organizer and does not display an address. The principal’s address was 438 E. Millsap Rd., Suite 103, Fayetteville, Arkansas. At one point, that address was associated with Story, but Story’s current business address was 3608 Steele Blvd., Fayetteville, Arkansas.

The exact owner of ALB Investments, LLC is unknown because Arkansas along with three other US states – Delaware, New Mexico, and Wyoming – has confidentiality clauses (in Arkansas it is Act 865, which was created in 2007).

On the day ALB Investments, LLC was formed, Josh and Anna Duggar sold their home in Siloam Springs to ALB Investments for $ 65,000 plus tax that same day [then located] in Siloam Springs.

The business address for ALB Investments is the same as the home address of Siloam Springs on Kinchloe Road. Story signed the deed as a scholarship holder and notary public. According to the state document, the date stamp issued by the district is the following day.

In summary, Alreadysh and Anna Duggar sold the house to themselves.

The five-bedroom, three-bath two-acre home sold for $ 336,500 in February 2020, according to real estate websites.

According to the Washington County Tax History for Joshua and Anna Duggar, they paid personal property taxes at two locations: 1900 block on N. Porter Road in Fayetteville (2010-2013) and 500 block on Arbor Acres Ave. in Springdale (2014-2020).

An online search was performed for ALB Investments, LLC of Arkansas for a website or service provided by ALB Investments, LLC, but nothing was displayed. There’s an ALB Investments, LLC in Farmington, Utah, but the company doesn’t appear to have any Arkansas connection.

In North Carolina there is an ALB Investments, LLC, which is part of Connected Investors. Owned by Tony Brannon, this agency appears to be a consortium of real estate investors. No partners in Arkansas were listed according to an online search.
